Gas Station Ordinance Tabled After Council Questions

Farmersville Planning and Zoning commissioners unanimously tabled a proposed zoning amendment for convenience stores with gas pumps after City Council sent the item back with questions about how it could affect business development. Council asked whether the rules might make it harder to open a business in town, limit competition or negatively affect future economic growth.

The proposal under discussion would add requirements for some gas station projects, including a limit that could confine stations to two corners of certain intersections and a requirement for a specific use permit. Commissioners said the intent was not to discourage development, but several members said the wording needed to be clearer before they could move ahead.

A major unresolved question was where the restriction would apply. Commissioners discussed whether the rule should be tied only to intersections of two major thoroughfares rather than all road intersections. They also talked about whether the ordinance should distinguish between a small convenience store with pumps and a much larger fueling facility.

To make that distinction, members considered whether the number of fuel pumps could be used as a threshold. Commissioners said that approach might keep smaller stores from being treated the same as larger projects, but no revised language was approved during the meeting.

Commissioners also said any changes could trigger another public hearing and public notice process, which added to the need for clarity before taking action. The item will return at a future meeting as discussions with City Council continue.
